Kenya Transporters Association files suit against SGR cargo directive

The Kenya Transporters Association (KTA) has filed a petition to the High Court of Mombasa, accusing the Kenya Ports Authority, the Kenya Revenue Authority and others, challenging the Government directive requiring that all Kenya-bound cargo arriving at the Port of Mombasa be transported via the Standard Gauge Railway (SGR).

The petition claims that the directive requiring constitutes a breach of public trust and a violation of the Constitution. They also claim that the order violates the Competition Act No. 12 of 2010 and the Consumer Protection Act No. 46 of 2012, because it gives the SGR a monopoly on cargo transport from the Port.

The order has caused Mombasa’s economy to collapse, as cargo bypasses the Coast region, which has traditionally depended on the Port.
